Please read these Terms of Service carefully before purchasing a program, enrolling in a course, or using any services offered by Embodied Joy Wellness LLC. By purchasing or enrolling, you agree to these terms.

Who we are
Embodied Joy Wellness LLC is a health and wellness coaching practice operated by Tiffany Mercer, based in Colorado Springs, Colorado. We offer personal training, nutrition coaching, behavior change coaching, and self-directed wellness courses through www.tiffanymercer.com and the Trainerize coaching platform.
What we offer
Our services fall into two categories.
Coaching programs are personalized training and coaching engagements delivered through the Trainerize app. These include The Collective and 1:1 Coaching. Program details, pricing, and what is included are described on the Programs page at www.tiffanymercer.com/programs.
Self-directed courses are available through a membership login on www.tiffanymercer.com. These courses are designed to be completed independently and do not include direct coaching access unless otherwise stated.
Payment terms
Coaching programs are offered on the following payment structures.
Month-to-month enrollment is billed on a recurring monthly basis with no contract and no minimum commitment period. Your billing date is set at the time of enrollment and recurs on the same date each month.
Pay-in-full options are available for 6-month and 12-month terms. Pay-in-full enrollments are billed as a single payment at the time of purchase.
Self-directed courses are billed as a single payment at the time of purchase unless otherwise stated on the course sales page.
All payments are processed in United States dollars. You are responsible for any applicable taxes in your jurisdiction.
Refund policy
We have a 24-hour refund window from the time of purchase. If you request a cancellation within 24 hours of your initial payment and your program has not yet begun, we will issue a full refund.
After 24 hours, or once your program has begun, no refunds will be issued. This applies to all coaching programs, regardless of payment structure.
This policy exists because program preparation begins immediately upon enrollment. Personalized workout programming, nutrition planning, and onboarding require significant time investment on our part before your first session or check-in. That time cannot be returned.
Pay-in-full enrollments (6-month or 12-month) are not eligible for refunds under any circumstances after the 24-hour window has passed.
Self-directed courses are non-refundable once you have accessed the course materials.
If you have a billing error or a technical issue that prevented you from accessing your program, contact us at info@tiffanymercer.com and we will work to resolve it promptly.
Cancellation policy
Month-to-month coaching enrollments may be cancelled at any time with 30 days written notice sent to info@tiffanymercer.com. Your final billing date will be the next scheduled payment that falls within that 30-day notice period. No additional charges will occur after that date.
Pay-in-full enrollments (6-month or 12-month) cannot be cancelled or refunded. If circumstances require a pause in participation, pay-in-full clients may request a hold of up to one calendar month. Hold requests are granted at our discretion and must be submitted in writing to info@tiffanymercer.com. The hold period does not extend your program term.
Self-directed course purchases are final and non-cancellable once access has been granted.
Program access
Coaching programs are delivered through the Trainerize platform. Upon enrollment you will receive instructions for accessing your account. You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account.
Self-directed courses are delivered through a membership login at www.tiffanymercer.com. Access is granted to the purchasing individual only and may not be shared, transferred, or resold.
If you experience technical difficulty accessing either platform, contact us at info@tiffanymercer.com and we will assist you.
Access to self-directed course materials is provided for the duration stated at the time of purchase. We reserve the right to update, revise, or retire course content over time. We will provide reasonable notice if a course you have purchased is being retired.
Health and wellness disclaimer
The coaching, programs, and courses offered by Embodied Joy Wellness LLC are for general fitness, nutrition, and wellness purposes only. They do not constitute medical advice, diagnosis, or treatment.
Before beginning any new fitness or nutrition program, you should consult with a qualified healthcare provider, particularly if you have any pre-existing medical conditions, injuries, or health concerns.
By enrolling in any program or course, you acknowledge that you are voluntarily participating in physical activity and that there is inherent risk involved. You agree to take responsibility for your own health and safety during all workouts and activities.
Results from our programs vary by individual. We make no guarantee of specific outcomes. Your results will depend on your individual circumstances, consistency, and effort.
Testimonials and likeness
We may use written testimonials provided by clients in our marketing materials, on our website, and in social media content. By providing a testimonial, you grant Embodied Joy Wellness LLC permission to use it for these purposes.
Photographs, video, or other identifying likeness of clients will never be used in any marketing or public-facing materials without express written consent obtained prior to use. Verbal consent is not sufficient. If you would like to withdraw previously granted written consent, contact us at info@tiffanymercer.com.
Intellectual property
All content on www.tiffanymercer.com and within our programs and courses, including but not limited to workout programming, nutrition guidance, written materials, videos, and course content, is the intellectual property of Embodied Joy Wellness LLC. You may not reproduce, distribute, sell, or share this content without prior written permission.
Limitation of liability
To the fullest extent permitted by law, Embodied Joy Wellness LLC and Tiffany Mercer shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services, programs, or website. Our total liability to you for any claim arising out of or relating to these terms or our services shall not exceed the amount you paid us in the 30 days preceding the claim.
Governing law
These Terms of Service are governed by the laws of the State of Colorado. Any disputes arising under these terms shall be resolved in the courts of El Paso County, Colorado.
Changes to these terms
We may update these Terms of Service from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the revised terms. We encourage you to review this page periodically.
